Terms of Service

By accessing apptuned.app (the “Site”) or using any Apptuned service, application, or tool (collectively, “Services”), you confirm that you are at least 18 years old (or have the consent of a parent or guardian) and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you are accepting these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Apptuned.app provides:

• AI Cognitive Assessments: AI-powered tools that analyse cognitive patterns and generate personalised strengths profiles. These are not clinical diagnoses.
• Workplace Inclusion Platform: SaaS tools for HR teams and managers to implement neuro-inclusive practices.
• Productivity Applications: Adaptive apps supporting neurodivergent individuals in task management, focus, and organisation.
• Consultancy Services: Professional advisory, training, and implementation services delivered by Apptuned specialists.
• AI Chat Assistant: A free on-site AI assistant providing general neurodiversity information and guidance.
• Resources & Blog: Free educational articles and guides on neurodiversity topics.

Important medical disclaimer: Apptuned’s tools are educational and supportive aids. They are not a substitute for formal clinical assessment, diagnosis, psychiatric evaluation, or medical treatment. Always consult a qualified health professional for clinical concerns.

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with others or permit unauthorised access.
• You must notify us immediately at hello@apptuned.app if you suspect unauthorised use of your account.
• We reserve the right to suspend accounts that violate these Terms.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable regulations.
• Attempt to reverse-engineer, decompile, or extract proprietary algorithms from our AI models.
• Scrape, harvest, or systematically extract data from the Site or Services without written permission.
• Upload or transmit malicious code, viruses, or any content that could harm our systems or users.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the AI Chat Assistant to generate content that is harmful, discriminatory, or violates the rights of others.
• Attempt to circumvent security measures, access restrictions, or rate limits.

All content on apptuned.app — including text, graphics, logos, software, AI models, and assessment methodologies — is the intellectual property of Apptuned Limited or its licensors, protected under Kenyan and international copyright law.

What you may do: Access and use the Services for their intended purpose; share links to articles; download free resource documents for personal or organisational use.

What you may not do: Reproduce, republish, or commercially distribute our content without written permission; claim ownership of AI-generated reports or profiles produced by our tools.

Your content: You retain ownership of data you submit. By submitting it, you grant Apptuned a limited licence to process it to deliver the Services.

• Paid plans are billed monthly or annually as selected at checkout.
• All prices are in USD unless otherwise stated; local currency equivalents may be shown.
• Subscription fees are non-refundable except where required by Kenyan consumer protection law or where Apptuned fails to deliver the subscribed service.
• We will provide at least 30 days’ notice of price changes to existing subscribers.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, or non-infringement. Apptuned does not warrant that the Services will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by Kenyan law, Apptuned’s total liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid to Apptuned in the 12 months preceding the claim, or (b) USD 100.

Apptuned shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

You agree to indemnify and hold harmless Apptuned Limited, its directors, officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of Kenya. Any dispute arising from or related to these Terms shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.

We reserve the right to modify these Terms at any time. We will provide at least 14 days’ notice of material changes via email or a prominent notice on the Site. Continued use of the Services after the effective date of changes constitutes acceptance of the updated Terms.
